Estate Plan

Estate planning is a complex area of law. When an estate planning matter affects your family and your future, the lawyer you consult must have the knowledge and experience necessary to fully protect your interests.

At Boyer Law Group, in Mission Viejo, California, we offer comprehensive legal representation from a knowledgeable and experienced estate planning attorney. Our founding attorney, David J. Boyer, has been practicing law for more than 15 years. A former district attorney for Orange County, he has dedicated his law practice to estate planning and related matters since 2008.

Mr. Boyer is a member of the Orange County Bar Association, the State Bar of California and volunteers as a pro bono attorney for the Public Law Center. He has dedicated himself to his community, working diligently to achieve the best possible results for California families. He is dedicated to helping families protect their relationships and their resources.

Areas of Practice

We are devoted to providing the highest quality legal representation to help you plan for your future and the future of your loved ones through the use of Wills, Trusts, Powers of Attorney, Advance Directives, Probate and Litigation when necessary.

Deciding what will happen to your home, your financial assets, and your personal possessions after your passing can be a difficult process. However, if you don’t take the time to make these decisions now, a court may end up dividing your property for you. Instead of leaving such important decisions to the courts, acquire the assistance you need to make wise decisions concerning your estate by consulting with an attorney at Boyer Law Group.

The decisions you make regarding your estate determine how your property will be divided and what estate taxes will need to be paid after your passing. Be sure that your wishes are carried out by consulting with Boyer Law Group.

Estate Planning

We are an estate planning firm that structures estate plans for individuals and families to protect them from unnecessary and expensive court proceedings and from needless federal and state taxes. These plans, which include Wills, Trusts, Powers of Attorney for Finances and Powers of Attorney for Healthcare, incorporate the most recent Trust and Probate Laws in order to provide our clients with the most up-to-date estate plans available.

Trust Administration

The duties and responsibilities of a Trustee are outlined in the trust itself, as well as under California law. Regardless of the type of trust involved, Trustees must be aware of their statutory duties and restrictions as well as those listed in the trust in order to avoid violations and unintended consequences. Otherwise, the acts of the Trustee could be determined as non-binding and can be disputed during the trust administration process, often resulting in drawn-out litigation.

Probate

The estate of a person who has died leaving a will or who has died intestate (without a will) must pass through the probate process. Probate involves three major actions: identifying and gathering the assets of the decedent; making payments to satisfy debts owed to the decedent’s creditors; and distributing the assets remaining to the beneficiaries of the estate. However, many of our clients want to avoid the probate process due to the expense in terms of court costs as well as the amount of time it takes to get through the process which, depending on the complexity of the case, can take an average of 12 to 18 months. If your estate must pass through probate, Boyer Law Group can guide you through the process and will work to protect your personal interests.

Trust and Probate Litigation

After a loved one passes away disputes often arise between Beneficiaries and Trustees of a Trust or Heirs and Executors of a Will and we realize that misunderstandings and arguments can evolve into legal battles which may result in litigation. David J. Boyer, the founding attorney of Boyer Law Group, has extensive litigation and trial experience while most probate and trust attorneys have little to no trial experience. We also utilize alternative dispute resolution techniques, such as mediation or arbitration, in an effort to settle a dispute before it turns into costly litigation.

However, we realize that family disputes in trust and probate litigation can become very intense. Therefore, we are prepared to be tenacious through each stage of the litigation process – from pleading and discovery, through motion practice, trial, and if needed, through appeal. No matter what your estate planning, trust administration, probate, or litigation issue may be, you can count on Boyer Law Group to vigorously represent your interests at every stage.
